Is Vaping Still Legal
In recent years, Juul, once the most beloved vape-producing company in the United States, was marked as dangerous for public health by the FDA. Why did it happen? Is it still legal to buy and use Juul production in the U.S.? And are all vapes going to be prohibited? Keep reading to know the answers!
The dubious past of Juul
The first time Juul faced problems with the FDA was in 2018. Then, the company was suspected of selling vapes to children. The next year, Juul produced ads where it said that their vapes were safer than ordinary cigarettes. These ads were seen by the FDA as unsafe for kids, promoting harmful habits among them. Also, in 2019, Juul was blamed for producing vapes with sweet, tasty flavors that kids like. According to the FDA, electronic cigarettes must have only tobacco or mint flavor. But now, this organization has gone even further and started trying to forbid Juul completely.
FDA’s attempts to close Juul
On June 23rd, FDA claimed that Juul must finish its sale of vapes and cartridges. In addition to that, the FDA said that the marketing authorization of this company wasn’t valid since, according to them, Juul hadn’t provided convincing toxicological information to prove the safety of their production. Like the majority of vape-producing companies, Juul has always claimed that its e-cigarettes are safer than traditional ones. Most people agree with it, but now, to have the right to sell vapes, a company has to provide solid proof of it.
Nicotine addiction among teens is declining now but is still a large problem, so the FDA’s concern is completely understandable. But it’s not the only reason: FDA also says that Juul devices contain dangerous chemicals that can potentially leak.
How did Juul defend itself?
FDA’s order was blocked by The U.S. Court of Appeals, but the story hasn’t ended yet. Juul was permitted to sell its vapes till the court got any additional information. Almost two years ago, Juul submitted a large application that contained an estimation of their cigarettes’ possible danger, but it was denied. However, FDA accepted similar applications made by many other vape-producing companies (but denied many of them too).
Will vapes be outlawed?
Juul’s cigarettes can still be bought in the U.S., but the situation may change at any moment. The possibility of their complete ban remains high. But, on the other hand, it’s important to note that this FDA order is only about Juul. There are many other vape companies whose production will remain legal even if Juul is forbidden.
However, nobody knows what can happen next, and the complete ban on all electronic cigarettes isn’t a totally impossible variant either.
